Terms and Conditions for Comedy TABC

The following are the terms of use between you, the Course Registrant (hereinafter referred to as “STUDENT”), and Comedy TABC (hereinafter referred to as “CTABC”), a dba of International Driver Training, Inc and is a legal agreement. By accessing, using, registering and/or browsing the Comedy TABC site, you acknowledge that you have read, understood, and agree to be bound by the Terms and Conditions of this Agreement. CTABC reserves the right, in its discretion to update or revise these Terms and Conditions and to post such updated or revised Terms and Conditions on this site. If you do not agree to these Terms and Conditions, please do not use this site. Please check the Terms and Conditions periodically for changes. Your continued use of this site following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.

Charges and Terms of Payment: The CTABC Course registration fee (“Fee”) must be paid in full before STUDENT begins the CTABC Course. The Fee includes the CTABC Course, it’s associated Unit testing and the Seller/Server Certificate (“Certificate”) upon successfully passing the TABC’s Commission Standard Competence Test (“Test”). Full payment of the Fee is due regardless of whether you pass the Test.

CTABC Course Schedule: STUDENT represents that STUDENT has verified whether CTABC is a TABC approved school through TABC’s website. The CTABC Course is a 120-minute course that includes the TABC’s mandatory curriculum, along with the mandatory the Test. The CTABC course has multiple chapters of instruction (“Units”) and testing on the material covered in the CTABC Course content.

STUDENT USE AND NON-USE OBLIGATIONS: In consideration of STUDENT’S use of services provided in this site, STUDENT agrees to provide a true, accurate, current and complete information about STUDENT. Under no circumstances shall STUDENT allow another person to take the Test on behalf of STUDENT. STUDENT shall not use, or permit others to use, this site in a manner or purpose contrary to the Terms and Conditions. STUDENT is responsible for all activities that occur under STUDENT’S password or account, and will keep the password(s) confidential. The CTABC Course if for STUDENT’S personal non-commercial use. STUDENT may not modify, copy, distribute, transmit, reproduce, publish any information from the CTABC course and Test obtained from this site.

Falsification of Documents and Misrepresentations. STUDENT understands that if STUDENT desires to receive a Certificate that TABC requires that the STUDENT must be a United States citizen or be legally authorized to work in the United States. Upon registration for the TABC Course, STUDENT understands that STUDENT must present evidence of its citizenship or work authorization. STUDENT authorizes CTABC to verify citizen and work authorization compliance. False documents or false information submitted to CTABC for compliance verification results in an issued Certificate being void and/or voidable and may lead to other legal consequences. By registering for the CTABC Course and receiving a Certificate, STUDENT represents that he/she viewed and understood all of the material for each Unit, completed the required duration, and successfully passed each Unit of the Test. If CTABC discovers that during the taking of the CTABC Course that STUDENT misrepresented himself/herself, or has cheated, STUDENT will be stopped from taking the course and shall not be eligible for a refund of the Fee. If STUDENT provided any information that is untrue, inaccurate, not current, or incomplete, or CTABC has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CTABC has the right to suspend or terminate the services provided to STUDENT and CTABC can refuse any and all current or future use of its services.

Grading and Progress Policy: The grading and progress policy is governed by the TABC. STUDENT understands that he/she may not be certified or given credit for the course unless STUDENT scores the TABC requirement of 70% or higher on the total Test exam. The STUDENT is required to complete a Unit and be tested for the Unit before proceeding to the next Unit. If STUDENT incorrectly answers more than one question on a unit test, the student must restart and complete the unit again before being retested for the Unit. In total, if STUDENT does not correctly answer at least 70% of the questions asked on the Test, STUDENT must retest immediately. If STUDENT does not correctly answer at least 70% of the questions asked on the re-test, the STUDENT must repeat the CTABC Course in full and will need to re-pay the Fee.

Cancellation and Refund Policy: Refunds are limited and are defined in this section. A full refund will be made to STUDENT if he/she cancels registration prior to commencing the CTABC Course. Additionally, the Fee is refundable when the course of instruction is discontinued by CTABC preventing STUDENT from completing the course. If STUDENT is eligible for a refund, then, the refund will be made within 30 days of the effective date of the refund request. Although the CTABC Course is self-paced, if STUDENT has not successfully commenced and/or completed the course within 180 days, his/her course registration will be terminated without notice, he/she will not be eligible for a refund, and will need to re-pay the CTABC Course in full in order to re-register for the CTABC course. In the event that STUDENT’s registration is terminated (due to failure to complete during 180-days) and STUDENT re-registers, STUDENT will not receive credit for any of the prior completed Units.

Completion and Certificate Policy: CTABC will electronically issue the STUDENT a Certificate within 24 hours only if STUDENT satisfies the requirements for a Certificate. See Grading and Progress Policy above. Duplicate Certificates can be requested directly from TABC.

Privacy Policy: STUDENT understands that information, including personal information, is collected by CTABC upon registration. STUDENT is advised that CTABC is required to report to the TABC STUDENT’s information, including personal information, for example, STUDENT’S name, birth date, successful completion of course, test score and certificate number. See also, https://www.tabc.state.tx.us/training_and_certification/information_for_schools.asp. CTABC is also required to keep in its records for four years, a STUDENT’S name, mailing address, email address, any information required to assign the student a commission approved personal identification number, and student’s score. The information about STUDENT collected by CTABC is subject to its privacy policy (except for required reporting of STUDENT’s information to TABC). CTABC recognizes the importance of protecting the privacy of its students and visitors to its website while permitting CTABC to conduct legitimate business. The collected information is used to: provide STUDENT with the course of instruction; to enable billing; electronically provide the Certificate (with verification to state agency); to communicate with STUDENT necessary to ensure TABC Course completion, testing, and processing of Certificate, among other business-related reasons. STUDENT represents that STUDENT has reviewed this privacy summary as well as the additional Privacy and Cookie information on CTABC’s website.

Duration and Revocation: STUDENT understands that a Certificate is good for two years. Further, STUDENT understands that TABC will revoke STUDENT’S Certificate under certain conditions. STUDENT is advised to fully review Section 50.31, TABC Rules Chapter 50 at TABC’s website.

Hardware and Software Requirements for Internet Use: STUDENT understands that the CTABC Course is an on-line course and requires certain technology that is STUDENT’s sole responsibility. An updated list of the technology required to take the TABC Course is available on CTABC’s website. In addition, the CTABC Course requires the use of a pointing device such as a mouse and speakers and/or headphones.

DISCLAIMER: The use of comedy is a tool and teaching technique that promotes and facilitates learning for some individuals. CTABC disclaims that all STUDENTS who take the CTABC course will pass the Commission Standard Competence Test for the issuance of a Certificate. While there may be entertainment in CTABC’s website and/or the CTABC Course, STUDENT understands that STUDENT is solely responsible to study, learn, and understand the CTABC Course contents sufficiently to pass the Commission Standard Competence Test. CTABC disclaims that STUDENTS who hold a CTABC Certificate prevents violations of the law because it is each STUDENT’S sole responsibility to ensure the law is followed in serving or selling alcohol.

LIMITATION OF LIABILITY: CTABC, ITS AFFILIATES, OWNERS, EMPLOYEES, CONTRACTORS, TRAINERS, AGENTS, LICENSORS, DISTRIBUTORS, SUPPLIERS (COLLECTIVELY, CTABC PARTIES”) SHALL NOT BE LIABLE TO STUDENT AND/OR ANY THIRD-PARTY AFFECTED BY STUDENT’S ACTIONS OR INACTIONS UNDER ANY CLAIM, DEMAND OR ACTION ARISING OUT OF OR RELATING TO THE CTABC COURSE OR THE ISSUANCE OF A CERTIFICATE TO STUDENT, WHETHER OR NOT THE COURSE WAS PAID BY STUDENT. CTABC AND THE CTABC PARTIES SHALL NOT BE LIABLE FOR COURSE INTERRUPTIONS, SHUTDOWN OF THE CTABC’S WEBSITE FOR REASONS RELATED TO WEATHER, ACTS OF GOD, OR WAR, TEMPORARY UNAVAILABILITY DUE TO MAINTENANCE, OR STUDENT AFFECTED BY COMPUTER VIRUSES THAT MIGHT ARISE FROM STUDENT VISITING THE CTABC WEBSITE OR FROM COMMUNICATIONS FROM CTABC, AND/OR FROM TAKING THE CTABC COURSE. CTABC MAKES NO EXPRESS OR IMPLIED WARRANTIES THAT STUDENT WILL SUCCESSFULLY PASS THE COMMISSION STANDARD COMPETENCE TEST, OR THAT STUDENT’S CERTIFICATE IS IRREVOCABLE. CLAIMS BY STUDENT OF ANY TYPE RELATED TO ALL THE AFORE-MENTIONED, INCLUDING CLAIMS OF BEACH OF CONTRACT, OR VIOLATIONS OF THE TEXAS DECEPTIVE PRACTICES ACT, OR A TORT ACTION, SHALL BE LIMITED TO THE AMOUNT PAID BY STUDENT FOR THE CTABC COURSE. FURTHER, STUDENT SHALL INDEMNIFY AND HOLD CTABC AND THE CTABC PARTIES HARMLESS FROM ANY AND ALL CLAIMS OF INJURY, DEATH, NEGLIGENCE, CLAIMS UNDER THE DRAM-SHOP ACT, OR ANY OTHER CLAIMS, LOSSES OR DAMAGES INCLUDING ATTORNEY’S FEES AND COSTS, THAT RELATE IN ANY WAY, DIRECTLY OR INDIRECTLY, TO STUDENT SELLING AND/OR SERVING ALCOHOL. STUDENT AGREES TO RELEASE AND HOLD CTABC HARMLESS FOR THE DISCLOSURE OF INFORMATION THAT IS REQUIRED TO BE PROVIDED TO TABC ABOUT STUDENT. CTABC AND THE CTABC PARTIES ARE NOT LIABLE FOR THE TABC’S HANDLING OF STUDENT’S PRIVATE INFORMATION OR REVOCATION OF STUDENT’S CERTIFICATE.

Notice. All demands, notices, communications, and reports required under these terms and conditions shall be in writing and shall be sent by reputable courier services or USPS via certified mail return receipt requested to:

General Provisions: These Terms and Conditions are governed by the State of Texas, without regard to conflict of laws provisions, and you agree to submit to the exclusive jurisdiction in the State of Texas. This agreement constitutes the entire contract between CTABC and STUDENT, and verbal assurances or promises not contained herein shall not bind CTABC. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, including but not limited to warranty disclaimers or liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
